{"id":81208,"date":"2026-04-15T15:07:08","date_gmt":"2026-04-15T15:07:08","guid":{"rendered":"https:\/\/ferabrajan.com\/portal\/?p=81208"},"modified":"2026-04-15T15:07:08","modified_gmt":"2026-04-15T15:07:08","slug":"scjn-tumba-delito-de-ciberasedio-en-puebla","status":"publish","type":"post","link":"https:\/\/ferabrajan.com\/portal\/2026\/04\/15\/scjn-tumba-delito-de-ciberasedio-en-puebla\/","title":{"rendered":"SCJN tumba delito de ciberasedio en Puebla"},"content":{"rendered":"<p data-start=\"48\" data-end=\"300\">La <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Suprema Corte de Justicia de la Naci\u00f3n<\/span><\/span> invalid\u00f3 el delito de <strong data-start=\"111\" data-end=\"128\">\u201cciberasedio\u201d<\/strong> en <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Puebla<\/span><\/span> al considerar que era <strong data-start=\"192\" data-end=\"239\">ambiguo y violaba el principio de legalidad<\/strong>, al no definir con claridad qu\u00e9 conductas eran sancionables.<\/p>\n<p data-start=\"302\" data-end=\"566\">El Pleno determin\u00f3 que t\u00e9rminos como <strong data-start=\"339\" data-end=\"389\">\u201cvigilar\u201d, \u201chostigar\u201d, \u201cofender\u201d o \u201cintimidar\u201d<\/strong> carec\u00edan de precisi\u00f3n jur\u00eddica, lo que generaba incertidumbre sobre cu\u00e1ndo se configuraba el delito y abr\u00eda la puerta a sanciones arbitrarias, incluso con <strong data-start=\"545\" data-end=\"565\">penas de prisi\u00f3n<\/strong>.<\/p>\n<p data-start=\"568\" data-end=\"826\">La Corte subray\u00f3 que cualquier regulaci\u00f3n en entornos digitales debe ser <strong data-start=\"641\" data-end=\"695\">clara, precisa y respetar la libertad de expresi\u00f3n<\/strong>, adem\u00e1s de ajustarse al principio de <strong data-start=\"733\" data-end=\"762\">m\u00ednima intervenci\u00f3n penal<\/strong>, evitando criminalizar conductas que no est\u00e1n bien delimitadas.<\/p>\n<p data-start=\"828\" data-end=\"1063\">Asimismo, advirti\u00f3 que normas de este tipo pueden provocar un <strong data-start=\"890\" data-end=\"931\">efecto inhibidor en el debate p\u00fablico<\/strong>, al generar temor entre usuarios de redes sociales por posibles consecuencias legales al expresar opiniones o interactuar en l\u00ednea.<\/p>\n<p data-start=\"1065\" data-end=\"1269\">El m\u00e1ximo tribunal tambi\u00e9n precis\u00f3 que <strong data-start=\"1104\" data-end=\"1161\">conductas como acoso o intimidaci\u00f3n no quedan impunes<\/strong>, ya que existen otros delitos claramente definidos que permiten sancionarlas, incluso en el \u00e1mbito digital.<\/p>\n<p data-start=\"1271\" data-end=\"1599\" data-is-last-node=\"\" data-is-only-node=\"\">En otro criterio, la Corte resolvi\u00f3 que el uso de la <strong data-start=\"1324\" data-end=\"1366\">Unidad de Medida y Actualizaci\u00f3n (UMA)<\/strong> para calcular indemnizaciones por muerte en materia civil <strong data-start=\"1425\" data-end=\"1461\">no afecta la reparaci\u00f3n del da\u00f1o<\/strong>, ya que las personas juzgadoras deben garantizar montos justos conforme a cada caso, con base en la ley y las circunstancias espec\u00edficas.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Suprema Corte de Justicia de la Naci\u00f3n invalid\u00f3 el delito de \u201cciberasedio\u201d en Puebla al considerar que era ambiguo y violaba el principio de legalidad<\/p>\n","protected":false},"author":1,"featured_media":81209,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_crdt_document":"","_monsterinsights_skip_tracking":false,"_uf_show_specific_survey":0,"_uf_disable_surveys":false,"footnotes":""},"categories":[53,52,585],"tags":[2784,26,898],"class_list":["post-81208","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-local","category-nacional","category-principal","tag-ciberasedio","tag-puebla","tag-scjn"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 -
